MICHELIN is giving you the chance to earn cash back on *each MICHELIN tyre purchased with a MICHELIN MasterCard.

The card functions as a debit card that can be used at any retailer with a swipe card facility. You could be rewarded with a MICHELIN MasterCard with every 16” and above tyre purchased when you register your invoice and MICHELIN MasterCard.

1. These terms and conditions apply to the MICHELIN WINTER promotion conducted by (MICHELIN South Africa). By entering into this promotion, you agree to be bound by the rules below:

2. MICHELIN is giving you the chance to earn cash back on *each MICHELIN tyre purchased with a MICHELIN MasterCard. 3. HOW TO ENTER & QUALIFY FOR THE MICHELIN MASTERCARD

 

3.1. Purchase MICHELIN 16” and above tyres from participating dealers

 

3.2. WhatsApp a picture of your invoice and MICHELIN MasterCard to 071 791 0117.

 

3.3. The card will be loaded with the relevant funds according to the purchase within 30mins of the WhatsApp request.

 

3.4. A reply message will be sent notifying you that the card has been activated and is ready for use

 

3.5. The entry will automatically go into the draw to stand a chance to win 1 of the total of 6 trips to Mauritius (Inch size dependent, as per clause 2.1, 2.2 and 2.3).

 

4. HOW TO ENTER & QUALIFY TO STAND A CHANCE TO WIN 1 of 6 TRIPS TO MAURITIUS

 

4.1. Purchase any selected MICHELIN tyres from 13” to 22” from any participating dealer (Inch size will determine which draw the consumer will qualify for. (Refer to clause 2.1,2.2  & 2.3)

4.3. A reply message will be sent notifying you that you have been entered into the draw to stand a chance to win 1 of 3 trips to Mauritius. 

 

5. QUALIFYING CRITERIA

PROMOTION RULES

 

6. TCC Fusion, and MICHELIN (South Africa) are collectively referred to as the “Promoters” in respect of the Promotion for purposes of these Terms and Conditions.

 

6.1. The following people shall not be eligible to participate in this promotion:

 

6.1.1. Directors, members, partners, promotional and advertising agents, employees or consultants of the “Promoters” and the Dealers participating to the current campaign.

 

6.1.2. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in a. above.

 

6.1.3. Persons under the age of 18 years.

 

7. Entry is charged as per WhatsApp Data costs alternatively standard Multimedia message rates. Free minutes do not apply.

 

8. This promotion commences on 15 June 2017 and shall run until midnight on 31 July 2017 (“Campaign Period”), subject always to any early termination or extension thereof by the “Promoters” as contemplated in these Terms and Conditions.

 

8.1. These Terms and Conditions override any advertising collateral or material in the event of any conflict.

 

9. Each entrant is expected to have purchased MICHELIN branded tyres (excluding BFGoodrich & MICHELIN Light Truck & MICHELIN Commercial) and be able to produce a valid invoice evidencing purchase in order to qualify.

 

10. Only end users will be considered as valid entrants, therefore purchased between dealerships will be not be considered. 

 

11. All entrants who participate in the competition and successfully comply with qualifying criteria have the opportunity of being rewarded with the MICHELIN MasterCard with the appropriate funds in accordance with their purchase and/or go into the draw to stand a chance to win 1 of 6 trips to Mauritius. 

 

12. If for any reason an entrant does not register their card by the 11 August 2017, then the cash back reward will be forfeited. 

 

13. Entrants may enter the competition as many times as they wish over the promotional period, provided that the entrant purchases the qualifying product each time and completes the competition entry requirements each time. Duplicate entries will not be entertained. 

 

14. Entrants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for competition entry purposes. If it is discovered that entrant has entered from a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the reward to promoter. This is to avoid fraud and to ensure compliance to the CPA.

 

15. Therefore each entrant is expected to be the owner of that phone and no singular person can enter off of another mobile phone number. This is to avoid additional fraud being conducted by multiple SIM card owners.

 

16. Each entrant is expected to have purchased one or more MICHELIN 16” or above tyres and be able to produce a valid invoice evidencing purchase in order to qualify for the Cash Back reward and stands a chance win 1 of 3 trips to Mauritius. 

 

17. Each entrant is expected to have purchased one or more MICHELIN 15” or below tyres and be able to produce a valid invoice evidencing purchase in order to qualify to stand a chance win 1 of 3 trips to Mauritius . 

 

MICHELIN MasterCard

 

18. Your card

 

18.1. Your card has an expiry date printed on the front of it. Your card is valid until the last day of the month shown, unless it is closed at your request or the Card Purchaser, or by Edenred if an incidence of fraud or potential fraudulent activity has been detected relating to your card.

 

18.2. Only the person whose signature is on the card will be able to use it.

 

18.3. Sign your card in ink as soon as you receive it in the space provided on the Back of the card.

 

18.4. Your card can only be used in the Republic of South Africa.

 

18.5. Your card will not have a personal identification number (PIN).

 

18.6. Your card must be cut in half after its expiry date.

 

18.7. You will not be sent any correspondence or statements.

 

18.8. The Issuing Bank will always be the owner of the card.

 

18.9. You are responsible for the safety of your card. Should your card be damaged, lost or copied Edenred or   the “Promoter” will not be liable.

 

19. Loading your card

 

19.1. Your card will be loaded with a Rand amount as determined by the “Promoter” in according to the Terms and Conditions.

 

19.2. Your card may be reloaded by the “Promoter” at any time before the expiry date of your card.

 

19.3. The balance available on your card may not exceed R 10,000 (ten thousand rand only) at any given time. 

 

20. Using your card

 

20.1. You may use your card to pay for goods and services at suppliers as per the ComplimentsTM programme acceptance detailed below:

 

20.1.1. ComplimentsTM – accepted where MasterCard is accepted.

 

20.1.2. ComplimentsTM Exclusive – accepted within the Compliments merchant network in South Africa.  

 

The merchant network is printed on the card wallet and/or card carrier which accompanied your card. You can find the most up-to-date merchant network at www.giftcards.co.za or www.incentivecards.co.za. Your card will not work at MasterCard acceptance locations which are not part of the Compliments merchant network. 

 

20.1.3. ComplimentsTM Select – intended for use within the Compliments merchant network in South Africa. The merchant network is printed on the card wallet and/or card carrier which accompanied your card. You can find the most up-to-date merchant network at www.giftcards.co.za or www.incentivecards.co.za. Should you choose to use your ComplimentsTM Select card outside of the Compliments merchant network you will incur a fee which will be deducted from the funds on your card. (Therefore accepted where MasterCard is accepted with implications outside the Compliments merchant network)

 

20.1.4. You will however not be able to use your card to pay for goods or services over the telephone or 

 

internet, pay toll-fees or for parking.

 

20.1.5. Your card cannot be used for any transactions at an ATM or at a bank teller. It can only be used 

 

in-store electronic terminals in the Republic of South Africa, as per the ComplimentsTM programme acceptance detailed above.

 

20.1.6. When you use your card to pay for goods or services you must sign a transaction slip.

 

20.1.7. Edenred will process the transaction against your available card balance. You will be able to 

 

shop at as many merchants as you wish up to the value on your card and after any deduction of fees if applicable. 

 

20.1.8. All transactions and fees will be authorised by Edenred against funds on your card.

 

20.1.9. Merchants are responsible for transactions and are independent of the Card Purchaser, Edenred and Standard Bank. The Card Purchaser, Edenred and Standard Bank, are not liable if the merchant does not accept your card or if you have complaints about goods or services paid for with your card.

 

20.1.10. Edenred or the “Promoter” is not responsible for any loss arising from any failure or malfunction  

 

of electronic facilities, delays in points-of-sale devices or Edenred’s supporting or shared

 

networks, where applicable, resulting from circumstances beyond Edenred’s reasonable control.

 

20.1.11. No warranties, purchase protection, insurance, other promises or services are provided.

 

20.1.12. Once you have paid for a purchase, you cannot stop the transaction.

 

You are responsible for keeping track of the transactions on your card to ensure that you do not exceed your card balance.

 

20.1.13. Balance enquiries can be made by sending an SMS with your 16 digit card number to 34246, by 

 

visiting www.giftcards.co.za or by calling 083 918 7700 (this is a 24 hour service) or 0861 11 40 93 between 9am and 6pm, seven days a week, including public holidays.

 

21. Fees and interest

 

21.1. You will not be charged any fees on any purchases made using your card within the Compliments 

 

merchant network in South Africa.

 

21.2. Should you choose to use your ComplimentsTM Select card outside of the Compliments merchant 

 

network you will incur a fee which will be deducted from the funds on your card.

 

21.3. A monthly fee will be deducted from the available funds on your card. This monthly fee will only be deductable after 12 months from the last time your card was loaded by the Card Purchaser.

 

21.4. You will not be paid any interest on the funds on your card.

 

22. Closing your card

 

22.1. Your card will be closed when it expires.

 

22.2. Edenred may choose to revoke your card at any time to protect Edenred’s interests. If your card is  

 

revoked for reasons other than fraud or unlawful use, any credit remaining on the card will be refunded to the “Promoter”.

 

23. Lost or Stolen cards

 

23.1. You are responsible for the safekeeping of your card. Your card is the same as having cash in your pocket. 

 

If you lose your card or if it is stolen and used by someone else, you will lose all the funds on your card.

 

24. Replacement cards

 

24.1. Edenred can stop and replace the card at the request of the Card Purchaser/ “Promoter”. Edenred will deduct a fee of R 100 (One hundred rand only) plus VAT from the existing card funds for the replacement card and for the transfer of funds. If there are insufficient funds to cover the replacement fee and the minimum load R 50 (Fifty rand only) the card will not be replaced.

25. TRIPS TO MAURITIUS

 

25.1. The draw will take place on the 14 August 2017.

 

25.2. The “Winners” will be selected by random draw and notified by telephone call confirming that they have won the “Trip to Mauritius”. The “Winner” will be contacted within 48 hours to arrange necessary documents for travel. If the winner cannot be contacted during this period, the prize will be deemed to have been forfeited by him/her. A new winner will be drawn and the same process followed.

 

25.3. If for any reason a “Winner” does not confirm a date of travel by 15 October 2017, then the trip will be forfeited. Any further draws will be conducted at the place and in the same manner as the original draw. The “Winner” of any unclaimed prize draw will be notified as set out in these terms and conditions.

 

25.4. The “Winner” will be required to sign an indemnity form.

 

25.5. The trip includes:

 

a. Return economy flights from OR Tambo International, Johannesburg to Ile Maurice Sir Seewoosagur, Mauritius;

 

b. Transfers from Ile Maurice Sir Seewoosagur airport to the hotel on arrival and back to the airport on the day of departure;

 

c. Six (6) days and five (5) nights stay in a standard room at a four star hotel selected by the “Promoters” for 2 adults (2) travelling between 1 September 2017 and 30 November 2017 excluding public holidays, long weekend and school holidays.

 

25.6. Hotel and flights and tours are subject to availability at time of booking.

 

25.7. The “Winners” must be in possession of a valid passport with expiry dates no less than three (3) months following the date of return to South Africa. If the “Winner” does not meet this condition, the trip will be forfeited and another “Winner” may be selected in accordance with the above rules.

 

25.8. The “Winner” will be responsible for arranging his/her passport, visa and other requirements for entry into Mauritius. The “Winner” bears all risks associated with any refusal of entry into Mauritius. No compensation will be payable if a “Winner” is unable to take the trip (or any part of it) as stated for whatever reason.

 

25.9. The Trip excludes:

 

a. Passport costs (should the “Winners” not have a valid passport), Visa costs, laundry, telephone, mini-bars, travel insurance, luggage insurance, gratuity.

 

b. The “Winners” will need to arrange their own transport to/from OR Tambo International airport in South Africa on their departure date and when they arrive back in South Africa.

 

c. Flights are upgradable at the “Winners” own expense.

 

d. Should “Winners” wish to extend their trip or change flights, it will be at their own expense and will not be a part of the package offered.

 

25.10. A full itinerary for the trip will be supplied to the “Winners”. Any additional expenses outside of the trip will be for the “Winners” own expense, and anything, including but not limited to any meal, activity, transportation, additional excursions, accommodation and all other costs and arrangements which are not included in the itinerary will be for the “Winners” expense.

 

 

26. The judges’ decision is final, and no correspondence will be entered into.

 

27. The MasterCard and Trip to Mauritius is not transferable, and no substitution or cash redemption of prizes is permitted

 

28. “Winners” may be required to take part in publicity campaigns for broadcast or publishing purposes. “Winners” or entrants shall at all times be entitled to decline the above request. “Winners” that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the “Promoter”.

 

29. The “Promoters” of the promotion reserve the right to cancel or postpone the promotion at any time.

 

30. The “Promoters” will continuously monitor any irregular behaviour, whether it be in entries and/or entrant’s details. Consequently, any violation or attempt and/or suspicion of violation or irregular behaviour and/or non-compliance with these Terms and Conditions will result in immediate disqualification of the entrant.

 

31. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the “Promoters” in terms of the Consumer Protection Act, 68 of 2008 ("CPA").

 

32. The entrant acknowledges that he/she has been given an appropriate opportunity to first read these Terms and Conditions and that he/she understands and accepts these Terms and Conditions.

 

33. All entrants participate entirely at their own risk. By reading and accepting these Terms and Conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the “Promoters”, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the promotion and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the “Promoters”.

 

34. The “Promoters”, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Entrant, or accept any liability for: (a) any inability by the entrant to use the Reward in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the Reward; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the Reward.

 

35. The “Promoters”, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any Reward nor in respect of any warranties or undertakings given by any person other than the “Promoters” themselves.

 

36. The “Promoters” reserve the right to terminate or extend the promotion at any time. In the event of such termination or extension, all entrants agree to waive (give up) any rights that they may have in terms of the promotion and acknowledge that they will have no recourse against the “Promoters”, its advertising agencies, advisors, suppliers and nominated agents.

 

37. By participating in the promotion, entrants acknowledge that the promotion will be managed in accordance with the provisions of the CPA. Qualifying entrants undertake to expeditiously do all things necessary to enable the “Promoters” to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the Reward to the entrant. Should any qualifying entrant refuse or be unable to comply with this requirement, the entrant shall be deemed to have rejected the Reward.

 

38. Michelin reserves the right to terminate/cancel the competition at any stage prior to the end of the competition period, whether as a result of changes in legislation, if required by any national, provincial or municipal authority or for any reason whatsoever. Notice of such termination shall be published on MICHELIN’s website at http://www.michelin.co.za   as soon as reasonably possible. In such event, all entrants waive any rights that they may have or purport to have in terms of the promotion, and acknowledge that they will have no recourse against Michelin whatsoever.

 

39. Confidentiality: Due to the nature of the campaign, TCC Fusion will not share any of the sales or Participant information with Michelin South Africa.

Your discount will be displayed on your invoice or online shopping cart total. All purchases on Michelin tyres will go into the draw to stand a chance to win 1 of a total of 6 trips to Mauritius. The campaign will run from 15th June until midnight on 31st July 2017.

 

2.1. 13” to 15” qualify for entry into the draw to stand a chance to win 1 of 3 trips to Mauritius.

 

2.2. 16”-17” qualify for R75 discount per tyre purchased.

 

2.3. 18” and above” qualify for R150 discount per tyre purchased.

3.3. All purchases go into the draw to stand a chance to win 1 of 6 trips to Mauritius. (Inch size dependent, as per clause 2.1, 2.2 and 2.3).

 

4. CAMPAIGN RULES

16. The discount and Trip to Mauritius is not transferable, and no substitution or cash redemption of prizes is permitted.

 

17. “Winners” may be required to take part in publicity campaigns for broadcast or publishing purposes. “Winners” or entrants shall at all times be entitled to decline the above request. “Winners” that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the “Promoter”.

 

18. The “Promoters” of the promotion reserve the right to cancel or postpone the promotion at any time.

 

19. The “Promoters” will continuously monitor any irregular behaviour, whether it be in entries and/or entrant’s details. Consequently, any violation or attempt and/or suspicion of violation or irregular behaviour and/or non-compliance with these Terms and Conditions will result in immediate disqualification of the entrant.

 

20. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the “Promoters” in terms of the Consumer Protection Act, 68 of 2008 ("CPA").

 

21. The entrant acknowledges that he/she has been given an appropriate opportunity to first read these Terms and Conditions and that he/she understands and accepts these Terms and Conditions.

 

22. All entrants participate entirely at their own risk. By reading and accepting these Terms and Conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the “Promoters”, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the promotion and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the “Promoters”.

 

23. The “Promoters”, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Entrant, or accept any liability for: (a) any inability by the entrant to use the Reward in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the Reward; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the Reward.

 

24. The “Promoters”, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any Reward nor in respect of any warranties or undertakings given by any person other than the “Promoters” themselves.

 

25. The “Promoters” reserve the right to terminate or extend the promotion at any time. In the event of such termination or extension, all entrants agree to waive (give up) any rights that they may have in terms of the promotion and acknowledge that they will have no recourse against the “Promoters”, its advertising agencies, advisors, suppliers and nominated agents.

 

26. By participating in the promotion, entrants acknowledge that the promotion will be managed in accordance with the provisions of the CPA. Qualifying entrants undertake to expeditiously do all things necessary to enable the “Promoters” to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the Reward to the entrant. Should any qualifying entrant refuse or be unable to comply with this requirement, the entrant shall be deemed to have rejected the Reward.

 

27. MICHELIN reserves the right to terminate/cancel the competition at any stage prior to the end of the competition period, whether as a result of changes in legislation, if required by any national, provincial or municipal authority or for any reason whatsoever. Notice of such termination shall be published on MICHELIN’s website at http://www.michelin.co.za   as soon as reasonably possible. In such event, all entrants waive any rights that they may have or purport to have in terms of the promotion, and acknowledge that they will have no recourse against Michelin whatsoever.

 

28. Confidentiality: Due to the nature of the campaign, TCC Fusion will not share any of the sales or Participant information with Michelin South Africa.
